Notice is hereby given that a number of transitional and consequential amendments to the regulations arise from the approval of Bill 39 to amend the Engineering, Geological and Geophysical Professions Act. Bill 39 created the regulatory framework for the One Act, Two Associations Memorandum of Understanding between APEGGA and ASET.

The Regulations amendments here are designed to
1. Allow existing Registered Engineering Technologists to maintain their status and continue to use their designation, although no further such designations would be issued should these amendments be approved.

2. Change the designation of existing Registered Professional Technologists to Professional Licensees.

3. Create a mechanism to maintain the future right of the APEGGA Board of Examiners to issue a limited licence to applicants who would have previously been nominated by ASET. These Members would also be Professional Licensees.

4. Eliminate the designation Registered Professional Technologist.

NOTE: The Professional Licensee designation should not be confused with another new designation, Professional Technologist (P.Tech.). Under Bill 39, P.Techs will be responsible for the routine application of specific, industry-recognized codes and standards and will be jointly regulated by ASET and APEGGA.

Amendments to Create Professional Geoscientist Designation

Notice is hereby given that amendments will be presented that would
1.  Change the name of the Association’s enabling legislation to the Engineering and Geoscience Professions Act of Alberta.

2.  Change the Association’s official name to the Association of Professional Engineers and Geoscientists of Alberta (APEGA).

3.  Replace the current definitions of “practice of geology” and “practice of geophysics” in Sections 1(r) and 1(s) of the Act with:

“practice of geoscience” means reporting on, advising on, evaluating, interpreting, processing, surveying, exploring, classifying reserves or examining activities related to the earth sciences and the environment;

(i) that is aimed at the discovery or development of oil, natural gas, coal, metallic or non-metallic minerals or precious stones, water or other natural resources, or that is aimed at the investigation of geoscientific conditions, and
(ii) that requires in the reporting, advising, evaluating, interpreting, processing, surveying, exploring, reserve classifying or examining the professional application of mathematics, chemistry, physics or biology through the application of the principles of geoscience, and
(iii) teaching geoscience at a university.

4.  Change sections of the Act that describe exclusive scope of practice of geology and exclusive scope of practice of geophysics to one section describing exclusive scope of practice of geoscience.

5.  Add a section of the Act that describes exclusive use of the name geoscientist while retaining sections that describe exclusive use of the names geologist and geophysicist. This would allow those members previously issued P.Geol. and P.Geoph. designations to keep them if they so wish, even though all newly licensed geoscientists would be granted the P.Geo. designation only.

6.  Change Section 14(2) of the Act to read
(2) The Council shall consist of
(a) at least 16 professional members among whom there shall be
not less than

(i) 2 professional engineers
(ii) 2 professional geoscientists.

7.  Make other changes as required to ensure the Act’s wording is consistent and to clarify the intentions of all the foregoing.
